THEIS, Senior District Judge. Appellant, James Minner, was convicted in state court in New Mexico of possession of cocaine with intent to distribute. After
trial, a supplemental information was filed charging that appellant was a fourth habitual offender. Minner exhausted his state
appeals and state habeas corpus remedies. Minner then petitioned for habeas corpus relief in federal court. The District Court
denied his petition, and Minner timely appealed. We affirm.
